Modern treaties with First Nations eliminate the application of the Indian Act completely, replacing it with comprehensive plans for governance, as well as land use and administration, taxation, and government-to-government relations, or provisions for those plans.

Modern treaty self-government agreements provide constitutionally protected governance rights over a larger land base than reserves, and the ability to create and manage Indigenous-owned land.
