Following are the primary organizations responsible for environmental regulation and assessment in Yukon. Each of these organizations was created by the Umbrella Final Agreement. Membership is usually composed of half First Nations and half Yukon and/or federal government, often with the chair appointed by the federal Minister on the recommendation of the other Board members.
Yukon Land Use Planning Council (YLUPC): helps government, Yukon First Nations and Regional Planning Commissions coordinate their efforts to conduct regional land use planning, including resolving land use and resource conflicts.
Yukon Environmental and Socioeconomic Assessment Board (YESAB): Created by Chapter 12 of the Umbrella Final Agreement, YESAB (originally called the Yukon Development Assessment Board) is an independent, arms-length organization that provides a framework for environmental assessment in Yukon, including areas without modern treaties. The assessment process and resulting decisions are transparent to the public.
Yukon Water Board (YWB): Created under Chapter 14 Water Management of the Umbrella Final Agreement, the YWB is an independent body that issues water use licences, and licences for the deposit of waste to water.
Fish and Wildlife Management Board: Created under Chapter 16 of the Umbrella Final Agreement, the Fish and Wildlife Management Board is “the primary instrument for fish and wildlife management in Yukon.” The Board may make recommendations on fish and wildlife management, legislation, research, policy and programs to the territorial Minister and to Yukon First Nations and Councils.
Yukon Salmon Sub-Committee: Created by Chapter 16 of the UFA, this is a sub-committee of the Yukon Fish and Wildlife Board, established as the main instrument for salmon management in Yukon. A non-government public advisory body, it provides recommendations to the Minister of Fisheries and Oceans and Yukon First Nations on matters related to salmon and their habitat.
Local Renewable Resources Councils: Also created by Chapter 16 of the UFA, these 10 local organizations manage local renewable resources as set out in the final agreements of each of the Yukon modern treaties. Each council can make recommendations to the Minister, the affected First Nation, the Fish and Wildlife Management Board and the Salmon Sub-Committee on matters related to fish and wildlife. The public is involved in the development of decisions and recommendations.
Yukon Surface Rights Board: Created under Chapter 8 of the Umbrella Final Agreement, this independent, impartial organization is a tribunal that hears and renders decisions on disputes related to accessing or using Yukon First Nation settlement land, and in some cases non-settlement land. Two of the five members are selected by the Council of Yukon First Nations, and two are selected by the Government of Yukon. The fifth member is appointed by the Minister of Crown-Indigenous Relations and Northern Affairs.
